1. About these Terms

These Terms and Conditions govern your use of the TDA Immigration & Student Services Limited website and any general information, forms, resources or online services made available through it.

In these Terms:

  • “TDA”, “we”, “us” and “our” mean TDA Immigration & Student Services Limited.

  • “Website” means this website and its associated webpages, online forms and digital resources.

  • “You” and “your” mean any person who accesses or uses the Website.

  • “Immigration services” means immigration advice, assistance or representation provided under a separate written agreement.

By accessing or using the Website, you agree to these Terms. If you do not agree, you should not use the Website.

2. About TDA

TDA Immigration & Student Services Limited is a New Zealand immigration advisory business.

Immigration advice is provided only by a person who is licensed or otherwise legally permitted to provide immigration advice under the Immigration Advisers Licensing Act 2007.

Our licensed immigration advisers are required to comply with the Licensed Immigration Advisers Code of Conduct 2014.

3. General information only

Information on this Website is provided for general information only.

Immigration law, operational instructions, government policies, application requirements, processing practices, fees and timeframes may change without notice. Information on the Website may not reflect the most recent change or may not apply to your individual circumstances.

Website information is not a substitute for personalised immigration advice.

You should not make an immigration, employment, education, travel, financial or legal decision solely on the basis of information published on the Website.

4. No adviser-client relationship from Website use

Accessing this Website, submitting a general enquiry, downloading information, subscribing to updates or communicating with TDA does not, by itself:

  • create an adviser-client relationship;

  • mean that TDA has agreed to act for you;

  • reserve an adviser’s availability;

  • require TDA to take action on your behalf;

  • mean that any deadline is being monitored by TDA; or

  • guarantee that TDA will accept your matter.

An adviser-client relationship begins only when TDA has:

  1. completed any necessary preliminary assessment and conflict checks;

  2. agreed to provide specified services;

  3. provided an appropriate written agreement or engagement documentation;

  4. received your acceptance of that agreement; and

  5. received any required initial payment or authority.

Until those steps are completed, you remain responsible for all application, visa, appeal, reconsideration, response and travel deadlines.

5. Immigration services and written agreements

Where TDA agrees to provide immigration services, the scope of those services, professional fees, government charges, disbursements, responsibilities, payment terms, complaint procedures and termination rights will be set out in a separate written agreement.

If there is any inconsistency between these Website Terms and a written agreement for immigration services, the written agreement will apply to the immigration services covered by it.

TDA will provide immigration services in accordance with applicable New Zealand law and the Licensed Immigration Advisers Code of Conduct.

6. No guarantee of outcome

Immigration decisions are made by Immigration New Zealand, the Minister of Immigration, the Immigration and Protection Tribunal, the courts or another relevant government body.

TDA cannot guarantee:

  • approval of an application;

  • the issue of a visa;

  • a particular visa duration or visa condition;

  • the success of an appeal, reconsideration, request or complaint;

  • processing within a particular timeframe;

  • that an immigration authority will request further information before deciding a matter; or

  • that immigration instructions or government policy will remain unchanged.

Any assessment or opinion provided by TDA is based on the information available at the time and remains subject to the independent decision-making powers of the relevant authority.

7. Your responsibilities

When communicating with TDA or engaging our services, you must:

  • provide complete, accurate and truthful information;

  • disclose all relevant facts, including facts that may adversely affect your matter;

  • provide genuine and unaltered documents;

  • review documents and application information carefully;

  • tell us promptly if your circumstances or contact details change;

  • comply with lawful requests for information and documents;

  • meet agreed deadlines; and

  • not ask TDA or any adviser to mislead an authority or act unlawfully or unethically.

Providing false, misleading, incomplete or altered information can result in an application being delayed or declined and may have serious immigration or legal consequences.

TDA may decline or cease to act where information appears false or misleading, instructions are unlawful or unethical, required cooperation is not provided, fees are not paid, or continuing to act would breach professional or legal obligations.

8. Website enquiries and document submissions

You are responsible for ensuring that information submitted through the Website is accurate and intended for TDA.

Submitting a form does not guarantee that it has been received, reviewed or accepted. If your matter is urgent or subject to a deadline, you must contact TDA directly and obtain confirmation.

You should not use a general Website enquiry form to send unnecessary sensitive information. Where possible, provide only the information requested and use the secure method specified by TDA for supporting documents.

TDA may delete unsolicited documents or information where we do not agree to act or have no lawful reason to retain them.

9. Fees and payments

General information on the Website about professional fees, government fees or other costs is indicative unless expressly stated otherwise.

The applicable fees and payment terms for immigration services will be confirmed in writing before or during the engagement.

Government fees, medical costs, police certificates, translations, qualification assessments, courier charges, appeal filing fees and other third-party expenses are generally separate unless the written agreement expressly states otherwise.

All fees are stated in New Zealand dollars and include GST where stated.

Nothing in these Terms limits any right or remedy available under applicable New Zealand consumer law.

10. Intellectual property

Unless otherwise stated, the Website and its original content, including text, branding, graphics, layouts, downloadable resources and document templates, are owned by or licensed to TDA.

You may view and print Website material for your personal, non-commercial use.

You must not, without prior written permission:

  • reproduce or republish substantial Website content;

  • use TDA templates commercially;

  • remove copyright or ownership notices;

  • present TDA content as your own;

  • modify or distribute Website content for commercial purposes; or

  • use TDA’s name, logo or branding in a way that suggests endorsement or association.

Government information, legislation and material belonging to third parties remain subject to the rights and terms of their respective owners.

11. Acceptable use

You must not use the Website:

  • for unlawful, fraudulent or misleading purposes;

  • to submit malicious software or harmful code;

  • to attempt unauthorised access to any system or account;

The Website may contain links to Immigration New Zealand, the Immigration Advisers Authority, education providers, government agencies and other third-party websites.

Links are provided for convenience and do not necessarily constitute endorsement.

TDA does not control third-party websites and is not responsible for their availability, accuracy, content, privacy practices, security or terms. You should review the applicable terms and privacy policies before using a third-party service.

13. Website availability and security

TDA takes reasonable steps to protect and maintain the Website. However, no website, internet transmission or electronic storage system can be guaranteed to be continuously available, error-free or completely secure.

TDA does not guarantee that:

  • the Website will always be available;

  • Website content will be free from errors or omissions;

  • transmissions will never be intercepted;

  • the Website will be free from all malicious software; or

  • defects will always be corrected immediately.

You are responsible for maintaining appropriate security on your own device, email account, passwords and internet connection.

14. Limitation of liability

To the maximum extent permitted by law, TDA is not liable for loss arising solely from:

  • reliance on general Website information without obtaining personalised advice;

  • outdated or incomplete Website information;

  • interruption or unavailability of the Website;

  • unauthorised access outside TDA’s reasonable control;

  • third-party websites or services;

  • malicious software introduced by a third party; or

  • information submitted to an incorrect address or through an unauthorised channel.

Nothing in these Terms excludes or limits liability where it cannot lawfully be excluded or limited, including rights under applicable consumer protection legislation.

Any liability arising from immigration services provided under a written engagement will be governed by that agreement and applicable law.

15. Complaints about immigration services

TDA aims to address concerns promptly and fairly.

Please explain:

  • what happened;

  • when it happened;

  • who was involved;

  • what outcome you are seeking; and

  • provide any relevant documents.

Clients may also have the right to complain to the Immigration Advisers Authority about the conduct of a licensed immigration adviser. Information about the Authority’s complaint process is available through the Immigration Advisers Authority.

Making a complaint will not result in adverse treatment by TDA.

16. Privacy

Personal information collected through the Website is handled in accordance with our Privacy Policy and applicable New Zealand privacy law.

Our Privacy Policy forms part of these Terms.

17. Changes to these Terms

TDA may update these Terms to reflect changes to our services, technology, business practices or legal obligations.

The current version will be published on the Website with its effective date. Changes apply from the date of publication unless otherwise stated.

18. Severability

If any part of these Terms is held to be invalid or unenforceable, the remaining provisions will continue to apply.

19. Governing law

These Terms are governed by New Zealand law.

Unless another forum is required by law, disputes relating to these Terms or the Website are subject to the jurisdiction of the New Zealand courts.
